EP Examination Process Guide - Puerto Rico Plans FAQs - Which returns must Puerto Rico plans file?

All Puerto Rico plans are required to file Form 5500, Annual Return/Report of Employee Benefit Plan, each year. Plans that are qualified only in Puerto Rico and not in the U. S. should include on line 8 the plan characteristics code 3C - Plan not intended to be qualified under Internal Revenue Code Sections 401, 403 or 408. All plans that have participants in Puerto Rico must file Form 480.70 with the Hacienda.
