Employee Plans Compliance Unit (EPCU) - Current Project - One Participant Defined Benefit Plan Schedule SB Project
Federal law requires defined benefit pension plans to complete and file Schedule SB or MB annually as part of their annual information returns; one-participant defined benefit plans are required to prepare and retain Schedule SB as part of their plan records, but are not required to file it with Form 5500-EZ. We are contacting sponsors who filed Form 5500-EZ for plan years ending in 2010 to ensure they are preparing and retaining Schedule SB as required.
The Project Process
We selected a sample from the population of one-participant defined benefit plans that filed Form 5500-EZ for plan years ending in 2010; we will correspond with these plans to solicit copies of the related Schedules SB. Our primary goal is to verify that the plans comply with the preparation and retention requirements.
If You Receive A Letter
Please provide a timely response to the information request, including contact information. If the plan is not a defined benefit plan, please contact us and provide an explanation. You may also furnish any other documents or clarifying material that you believe will be helpful for us to review. You should make every effort to be as complete and accurate as possible in your responses.
This letter initiates a compliance check. We will not inspect your books and records to determine an income tax liability for a particular period. Failure to respond may not, of itself, be cause for an examination of your plan; but may necessitate other actions, including examination of the plan, to ascertain compliance.
