Reasons for Disallowed EIC

If the IRS has determined that a taxpayer has claimed the EIC:

  • With reckless or intentional disregard of rules or regulations, then the taxpayer is ineligible to claim the EIC for a subsequent period of two years

  • Fraudulently, then the taxpayer is ineligible to claim the EIC for a subsequent period of ten years
