Act section 424 of The Tax Relief and Health Care Act of 2006 changed the way a charitable remainder trust, described under section 664, is taxed on its unrelated business taxable income. A charitable remainder trust no longer files Form 1041 if it has any unrelated business taxable income. Now, a charitable remainder trust pays tax only on its unrelated business taxable income. The tax imposed is equal to the trust's unrelated business taxable income and the tax is treated as an excise tax under Chapter 42 of the Internal Revenue Code.
