Purpose

(1) This transmits new IRM 1.2.64, Servicewide Policies and Authorities, Functional Delegations of Authority for Agency-Wide Shared Services.

Overview of AWSS Delegation Orders

  1. This IRM contains restructured and renumbered AWSS Functional Delegation Orders. Distribution of this IRM should include all persons with a need for any of the authorities or information in this section. All Functional Delegation Orders are approved by the Chief, AWSS and are listed in numerical order below.

  2. Each AWSS Delegation Order is based on a Servicewide Delegation Order. Servicewide Delegations of Authority are broken down by business process and can be found in IRM 1.2.40 through IRM 1.2.54. A Portable Document Format (PDF) version of this IRM can be obtained through the Electronic Publishing web site at http://publish.no.irs.gov.

  1. Delegation of reimbursement for actual subsistence, certain emergency travel situations or temporary relocation

  2. Authority: To authorize or approve:

    1. Reimbursement for subsistence expenses on an actual expense basis;

    2. Travel and transportation expenses for emergency purposes.

  3. Delegated to: Directors who report to the Chief, Agency-Wide Shared Services.

  4. Authority: To authorize advance of funds related to reimbursement for subsistence expenses on an actual expense basis and for travel and transportation expenses for emergency purposes.

  1. Delegation to approve attendance at meetings at government expense

  2. Authority: To approve attendance of employees at meetings of scientific or professional societies, municipal, state, federal, or other organizations, not national in scope, held within the respective area of responsibility or geographic area serviced for the purpose of transmitting or receiving information or knowledge relating to the administrative activities of the Internal Revenue Service.

  1. Approval of Travel Advances, Travel and Transportation Services, and Travel Vouchers

  2. Authority: To direct official travel and approve advances and travel vouchers for reimbursement of expenses, including non-workday travel, under the Federal Travel Regulation and Treasury and Service travel and relocation guidance.

  3. Delegated to: All managers.

  4. Redelegation: This authority may not be redelegated.

Delegation Order AWSS-6-1-1 (formerly AWSS-23)

  1. Delegation authority to create and abolish positions

  2. Authority: To create and abolish positions. The abolishment of a position is defined as the actual termination of the position, with the duties eliminated entirely or combined with the duties of another position or positions.

  3. Delegated to: Executive level directors, one-level below the chief.

  4. Redelegation: This authority may not be redelegated.

Delegation Order AWSS-39-1 (formerly AWSS-8)

  1. Delegation to authorize tour of duty

  2. Authority: To establish tours of duty for educational purposes for employees under their jurisdiction.

  3. Delegated to: Second-level managers.

  4. Authority: To prescribe the official hours of duty and, when necessitated by operating requirements, establish and administrative work week of five 8 hour days other than Monday through Friday for employees whose services are required on Saturday and/or Sunday.

  5. Delegated to: First-level supervisors.

  6. Redelegation: This authority may not be redelegated.

  7. Source of Authority: Servicewide Delegation Order 39.

Delegation Order AWSS-50-1 (formerly AWSS-21)

  1. Delegation of withholding compensation due personnel

  2. Authority: To make administrative determination of the amount of an erroneous payment, based on a statement of findings of fact, and to arrange with the employee the method of repayment and the amounts to be collected or deducted from the gross pay of the employee, in accordance with regulations prescribed by the Treasury Department.

  3. Delegated to: Two supervisory levels above the employee.

  4. Redelegation: This authority may not be redelegated.

  5. Source of Authority: Servicewide Delegation Order 50.

Delegation Order AWSS-81-1 (formerly AWSS-20)

  1. Delegation of Authority in Adverse/Disciplinary and Other Actions

  2. Authority: To effect adverse actions and actions based on unacceptable performance (removals, reductions in grade or pay, suspensions of more than 14 calendar days, indefinite suspensions, and furloughs without pay).

  3. Delegated to: All Executives to whom a subordinate manager has proposed an action.

  4. Authority: To propose adverse actions and actions based on unacceptable performance (removals, reductions in grade or pay, suspensions of more than 14 calendar days, indefinite suspensions, furloughs without pay).

  5. Delegated to: Two supervisory levels above the employee for whom the action is proposed.

  6. Authority: To propose and/or effect suspensions of 14 calendar days or less, written reprimands, written admonishment, warning letters and letters of caution, closed without action and clearance letters, and suitability determinations.

  7. Delegated to: Two supervisory levels above the employee for whom the action is proposed and/or effected.

  8. Redelegation: This authority may not be redelegated. AWSS Directors may at their discretion designate specific levels within their organization with the authority for adverse/disciplinary actions. However, the designations cannot be lower than the authorities specified in this delegation.

  2. Authority: To approve monetary awards and exceptions to monetary award scales for any one individual or group and incur necessary expenses for the recognition of contributions.

    1. Directors for awards up to and including $5,000.

    2. Three supervisory levels above the employee for awards up to and including $3,000.

    3. Two supervisory levels above the employee for awards up to and including $1,500.

    Note:

    The approval levels are subject to the availability of funds and are for employees under their jurisdiction and contributions of employees of other Government agencies and armed forces members.

  1. Authority to Approve the Use of Cash to Purchase Official Passenger Transportation Services Exceeding $500

  2. Authority: To authorize or approve use of cash to procure emergency passenger transportation services costing no more than $500, and to request exemptions, when necessary from the General Services Administration, for non-emergency cash purchases of passenger transportation services exceeding the $500 limitation.

  2. Authority: To settle EEO Complaints for the following:

    1. Agreements up to $25,000 (this includes informal, formal and U.S. District Court cases)

    2. Complaints involving employees grades 15 and below (e.g., priority placements, promotions, adverse/disciplinary actions, reassignments and awards)

    3. Allegations of sexual harassment involving employees and managers within functional division.

  3. Delegated to: Executive Leadership (Division Directors and Deputy Division Directors)

    Note:

    Requires pre-discussion and coordination with AWSS EEOD Director.

  4. Authority: To settle informal and formal EEO Complaints within established funding and management authorities, for the following:

    1. Allegations of sexual harassment involving employees within their organization

    2. Restoration of sick/annual leave

    3. Reasonable Accommodations

    4. Reassignments/details

    5. Training/developmental assignments

    6. Evaluations

    7. Removal of counseling memorandum and/or documentation

    8. Disciplinary actions

    9. Any non-monetary resolutions that are not precedent setting

  5. Delegated to: Senior Managers (Operations Directors, Associate Directors, Office Directors, and Office Deputy Directors)

    Note:

    Recommend pre-discussion and coordination with next level management. Settlement of formal complaints requires pre-discussion and coordination with AWSS EEOD Director.

  6. Authority: The authority to settle EEO pre-complaints (informal) within established funding and management authorities, for the following:

    1. Evaluations

    2. Training/Developmental assignments

    3. Removal of counseling memorandum and/or documentation

    4. Assignment of duties

    5. Working conditions

  2. Authority: To approve leave without pay in excess of one year in regulations and policies.

Delegation Order AWSS-257-1

  1. Delegation to carryover annual leave

  2. Authority: To make determinations that the exigency of the public business is of such importance that scheduled annual leave may not be used by an employee and therefore may be carried over in accordance with applicable statutes, executive orders, regulations and policies.

  3. Delegated to: Executive level directors, one-level below the chief.

  4. Redelegation: Exigency determinations must not be made by any official whose leave would be affected by the decision. In the event of such conflict, the determination shall be made at the next higher managerial level. This authority may not be redelegated.
