Exception: Private foundation self-dealing - certain dispositions required by excess business holdings rules

 

There is a limited exception from the taxes on self-dealing for private foundations that dispose of certain excess business holdings to disqualified persons as long as the sales price at least equals the fair market value.

The excess business holdings involved are those interests that are subject to the transitional rules and that would be subject to the initial tax if the required reductions in amount were not accomplished.
