Yes, a plan can specifically state that an employee’s affirmative election not to participate in the automatic contribution arrangement expires either annually or upon some stated event. It can then require the employee to make a new affirmative election (opt out) before automatically enrolling him or her in the plan’s automatic contribution arrangement.
